Terms & Conditions
Please read the below-mentioned terms and conditions carefully constituting an integral part of the Participant Agreement for the event. All events advertised in our brochures and on our website are operated by Natventure, (hereinafter called ‘Natventure’, ’we’, ‘us’ or ‘our’), and are sold subject to the following conditions. By booking with us you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions. Acceptance of your booking will be confirmed in writing or by confirmation email sent by us to you and a contract comes into existence on the date shown on your confirmation letter or email.
If you have any queries regarding these Conditions or do not understand them, please raise your query with a member of our staff.
Adequate and valid travel insurance is a mandatory requirement for all international (Non-Indian) participants and the same should be obtained before the date of departure. It is advisable, though not mandatory, for the domestic (Indian) participants also to get themselves adequately insured. Participants shall not be insured by Natventure, unless mentioned specifically.
How to Book
To make a booking, you can contact us through email/phone, our website www.natventure.in, or through an approved travel agent. The person making the booking must be 18 years old or over and must possess the legal capacity and authority to make the booking. If one person is making the booking on behalf of other people then after the booking of the event, other people will also be required to take the undertaking of accepting the terms and conditions mentioned in this agreement. All international (Non-Indian) participants may also be required to pay for any non-transferable and non-refundable items such as National Park entrance fees and Permits as per the requirements of the particular Park/permits applicable for all international (Non-Indian) participants. In case of bookings made by paying a partial amount, you are expected to make the balance payment at least 15 days prior to the departure date.
The assumption of risk during the tour
Natventure operates trips in regions where standards of accommodation, transport, safety, hygiene, medical facilities and other infrastructure may, at times, not be of the standard that you are used to at home.
By booking with us you acknowledge that participation in all Natventure trips involves inherent risks that may not be present in the case of conventional or less demanding holidays. These risks include, without limitation, the possibility of injury or death, psychological trauma, disease, loss or damage to property, inconvenience and discomfort.
Where Natventure provides services it will do so with due care and skill. Natventure is not responsible for the acts and omissions of others, including tour guides, accommodation providers or for any loss, damage, death, injury or expense (including loss of money paid in advance), which you may incur as a consequence of the acts and omissions of others.
Natventure will not accept responsibility or liability if you contravene any law or regulation of any country or region visited. Any independent arrangements that you make that are not part of our trip (including pre- and post accommodation) are entirely at your own risk and We cannot and does not give you any assurance, representation or warranty in connection with any such arrangements.
To the fullest extent permitted by law and subject to any exception set out below, we does not accept liability for any loss, death, injury or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with or arising from this contract or your participation in a tour, or in respect of a failure or omission on the part of us to comply with its obligations under this contract, or in respect of any other conduct that we undertakes in connection with a trip. To the fullest extent permitted by law and subject to the exception set out below, you also agree to release us and its employees and representatives (“Representatives”) from all costs, liability, loss and damage incurred by you in connection with your participation in any trip, and waive any associated claims that you may have against us or its Representatives as a result of your participation in any Tours.
Right of the Leader
At all times the decision of the Natventure Tour leader or representative will be final on all matters likely to affect the safety and well-being of the trip. If you fail to comply with a decision made by our Leader or interfere with the well-being of the group, then the Leader reserves the right to terminate this contract and order you to leave the tour immediately, with no right of refund.
All clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen event as described in the itinerary. No unaccompanied minors (those under 18 years of age) can be accepted however minors aged between 10 -17 years may accompany their parent or guardian who accepts full responsibility for them. Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or mental condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the event. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the event in which case all monies paid will be forfeit. If you have any complaint about your trip, you must make it known at the earliest opportunity to the leader or local representative, who will normally be able to take appropriate action. If at the end of the trip you feel your complaint has not been properly dealt with you must notify us in writing within 30 days of the end of your trip.
Local Laws & Customs
Laws and customs of the areas we visit can be very different to those we are used to. Be aware of your actions to ensure that they do not offend, especially if you are visiting religious areas. It is your responsibility to familiarize yourself with and respect local laws and customs. If you fail to do so, we will have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.
Updating of Terms and Condition
The Company reserves the right to update and/or alter these terms and conditions at any time, and it is the Clients responsibility to be familiar with them. The latest terms and conditions can always be found on the Company website www.natventure.in and will supersede any previous versions.
You agree that Natventure may use images of you taken during the trip without recourse to you and without compensation to you, for publicity and promotion purposes only through whatever medium it chooses.
In case of Emergency Evacuation
While we do have first aid and experts available on all our events but still there might be situations in which an emergency evacuation might be needed. We are committed to making a safe evacuation for you in case of an emergency. We would make necessary and adequate arrangements for your evacuation till the nearest road head that is well connected by road, and would also help you in boarding a vehicle to the nearest Hospital or any other facility so required. Any additional expenses incurred, that of porters, vehicle, ambulance, hospitalization, or any other expense incurred for evacuation, would be covered by the participant.
Governing Law and Jurisdiction
All disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Guwahati, Assam, India only.
